ADS Submits Comments
on Bioterrorism Act
ADS has been following closely the activities of the Food and Drug Administration
(FDA) with regards to the Public Health Security and Bioterrorism Preparedness
and Response Act of 2002 (Bioterrorism Act). The Bioterrorism Act provides the
FDA with new authority to protect the food supply in the United States.
The FDA recently published
in the Federal Register proposed regulations for Establishment and Maintenance
of Records (Volume 68, 25187-25240) and Administrative Detention (Volume 68, 25241-25271).
ADS Monitors Qualified
Health Claims Ruling
The Food and Drug Administration (FDA) recently announced an initiative to implement
an interim process for review of qualified health claims in food labeling that
will allow food products to carry FDA-approved health claims, provided that FDA
determines that the claims are supported by science and the claims accurately
convey any scientific uncertainty about the claims. The process includes an interim
ranking system the FDA will use to systematically evaluate the scientific evidence
supporting qualified health claims. This new initiative is the result of recommendations
by FDA's Task Force on Consumer Health Information for Better Nutrition as outlined
in its report, "Consumer Health Information for Better Nutrition Initiative."
The Task Force also presents three possible longer-term options for regulating
health claims, which the Agency intends to develop through rulemaking about one
year from now. The link to FDA's Web site, which includes a variety of information
recently released by the FDA regarding health claims is: http://www.fda.gov/oc/mcclellan/chbn.html.
